Whether you’re a first-time buyer or you’ve owned a pool your whole life, you may be wondering if you have to have a fence around your pool. The short answer is yes, but it’s for a variety of good reasons and can enhance your swimming experience.
Residential Pools
The laws for residential pools in Illinois state that an in-ground pool, such as a fiberglass pool, must have a fence at least 3.5 feet high around the area. This, however, does NOT apply to above-ground pools or hot tubs that stand at least 3.5 feet tall. The main reason behind this law is safety, specifically for children. While it’s not legally required, you can also choose to add ‘‘No Trespassing” signs or even alarms on your fence’s gate to deter the neighborhood kids from wandering too close to your swimming pool unsupervised.
Public Pools
If you’re installing a pool for your business to be used by the public, the laws are a little different. You must have a fence around your pool that is at least 4 feet high and has no footholds for climbing. There can also be no more than a 4-inch vertical clearance from the ground to the bottom of the fence and no openings on your fencing that are greater than 4 inches. Additional regulations for public pools are:
- A sign stating the maximum occupancy for the pool.
- A “No Lifeguard on Duty” sign that states no minor under the age of 16 may swim unsupervised.
- A sign with pool rules posted at the entrance to the swimming area and the dressing rooms.
- All fencing must include a self-closing and self-latching lock on the gate.
